Stoprussellhomes campaigners launch appeal to fund judicial review

StopRussellHomes campaigners have launched a public appeal for pledges towards the costs of funding a Judicial Review of the decision by Rochdale Borough Council to grant planning permission for the development of 110 houses on Land Off New Road, Littleborough.

Spokesperson Tony Perkins explained: “We are currently in the process of seeking legal advice on whether we have grounds to seek Judicial Review of the decision taken. Judicial Review will test the legality, fairness, and rationality of that decision.

"A Judicial Review cannot decide whether to reject or approve the planning application, but can however quash the original decision, so the application has to be brought back to the Planning and Licensing Committee for redetermination.

On receipt of the legal advice we will decide whether to commence formal proceedings and in the event of taking formal action some costs will be incurred. For this reason we are launching a fund raising campaign.”

James Rothwell added: “'At this stage we are not asking contributors to pay any money. We are simply requesting a pledge indicating how much they would be prepared to contribute should the need arise. Pledges would only be called in should our legal advisors confirm that we have the grounds to apply for Judicial Review and prior to starting formal proceedings.

“As there is only a short timeframe to request Judicial Review after the Council has issued its decision notice, we have decided that we need to commence the campaign now, and in advance of receipt of legal advice, otherwise we may have too short a time to act. We would like to offer our thanks and appreciation in advance for all pledges received.”
