Corporate Manslaughter and Corporate Homicide Act

Date published: 31 July 2007

Companies whose gross negligence causes deaths will face prosecution for manslaughter under new legislation.

The Corporate Manslaughter and Corporate Homicide Act has been given royal assent and comes into force in April 2008.

Justice Minister Maria Eagle said the new act would make it easier to prosecute companies and large organisations for gross failures; and take away Crown immunity, meaning Government departments, police forces and other public bodies can be taken to court.

Justice Minister Maria Eagle said the new act will make it easier to prosecute companies and large organisations for gross failures, and takes away Crown immunity, meaning Government departments, police forces and other public bodies can be taken to court.

She added: “For too long it has been virtually impossible to prosecute large companies for management failures leading to deaths.”
