Fly-tipper ordered to pay £292 after dumping rubbish in Sparth

Maria Trusek, a fly-tipper who illegally dumped waste, has been fined £220, ordered to pay £50 costs and a victim surcharge of £22.

On Tuesday 8 July at Bury & Rochdale Magistrates Court Trusek, 33, of Turf Hill Road, Rochdale, pleaded guilty to one offence contrary to s33(1)(a) Environmental Protection Act 1990, of depositing waste on land which did not have the benefit of an environmental permit (fly-tipping).

Representing herself and speaking through an interpreter, Trusek explained to the court that she had been advised by a friend of a place she could dispose of her waste on Corporation Road, Sparth, and was driven there to dump it. The bench pointed out that she would have passed close to a waste centre on the journey from her home to the location of the fly-tipping.

On inspection by Rochdale Borough Council enforcement officers the waste was found to contain documents addressed to Trusek.

Under the new sentencing guidelines for such offences, the court determined that this was a deliberate offence resulting in category three harm (impact on the amenity of the area and low clean-up costs).

Having assessed Trusek’s financial situation and given credit for her guilty plea, the court imposed a fine of £220, a contribution towards costs of £50 and the victim surcharge of £22 (total: £292) to be deducted from her benefits at a rate of £5 per week, the first payment to be made within 14 days. A Collection Order was made.
