Council considers legal action over planning breach
Date published: 10 September 2009
Rochdale Council is considering legal action against a leading UK house building company following a breach of planning regulations.
Persimmons Homes was required to carry out landscaping works as one of the Council's conditions to grant permission for developments on the Claymere Estate in Norden.
This work has not been completed despite a decision by the Rochdale Township Planning Committee earlier this year which threatened to serve Persimmons Homes with a breach of condition notice if the landscaping was not carried out.
If Persimmons Homes fails to act, the Council could take legal action.
Norden ward councillor Wera Hobhouse said: "For a while Persimmons was at least cutting the grass but they have stopped doing even that now. It is a hugely frustrating situation for residents and the Council, but I hope that the latest Planning decision will give the Council at least the tools to take Persimmons to court if they continue to fail on their obligations."
