The BNP, which has a European seat in the North West covering Rochdale, could face legal action over its membership rules.
The Equality and Human Rights Commission wrote to the party over alleged breaches of the Race Relations Act, and stated that the policies are discriminatory in connection with race and colour.
The BNP has been ordered to comply with the act before July 20, or face possible legal action.
Rochdale people now have a BNP member of European Parliament, after 4905 people from the borough voted for them in this year’s European Elections.
